Terms of Service

LightSweep offers tools that help you review and manage certain content stored on your device, including photos, videos, and contact records. Depending on the version and your access rights, the App may assist with identifying similar, duplicate, large, or otherwise reviewable items and allow you to select content for deletion or modification.

The App provides management assistance rather than independent storage, backup, or recovery services. Unless a feature expressly states otherwise, your photos, videos, and contacts remain stored on your device or in the cloud accounts connected to it.

Available features may vary according to:

• your device and operating-system version;
• permissions granted to the App;
• your country or region;
• the App version installed;
• whether you use free or paid access; and
• technical or marketplace requirements.

We may improve, replace, limit, or discontinue features where reasonably necessary, subject to applicable consumer law.

The App may use automated methods to group or identify content that appears duplicated, similar, large, or potentially unnecessary. These results are recommendations for review and may not accurately reflect the value, quality, uniqueness, or importance of an item.

You are solely responsible for checking every selection before confirming a deletion, merge, edit, or other change. The App must not be treated as a substitute for your own review.

In particular:

• visually similar photos may still contain meaningful differences;
• duplicate-detection results may include different versions of an image or video;
• large files may be important despite occupying substantial storage;
• separate contact records may belong to different people; and
• combining or changing contacts may alter information across connected accounts.

BEES Nest does not decide which personal content should be retained or removed.

You should maintain a suitable backup of important photos, videos, and contacts before using any cleaning or management function.

Depending on the operating system, deleted media may remain temporarily recoverable through a “Recently Deleted” album. That recovery period and the availability of recovery are controlled by the device platform, not by BEES Nest.

Contact changes may synchronize through iCloud, Google, Microsoft, or another account configured on your device. A change made through the App may therefore appear on other connected devices. We do not control those synchronization services and cannot guarantee that a deleted or modified contact can be restored.

You acknowledge that:

• some deletion or modification actions may be permanent;
• removing the App does not restore previously deleted content;
• BEES Nest may not possess copies of content processed locally; and
• we may be unable to recover photos, videos, contacts, or cleaning selections lost through your actions, device failure, or third-party synchronization.

Subject to these Terms, BEES Nest grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use the App on a device that you own or control.

This licence is provided for lawful personal use or legitimate internal business use. It does not transfer ownership of the App or permit you to commercially distribute or exploit it.

You may not:

• copy, resell, rent, sublicense, or redistribute the App;
• modify, reverse engineer, decompile, or attempt to obtain its source code, except where expressly permitted by law;
• bypass payment, access, advertising, or security controls;
• use automated tools to scrape, probe, overload, or interfere with the App;
• introduce malware or other harmful code;
• use the App to access or modify another person’s content without authority;
• use contact information for spam, harassment, fraud, or unlawful profiling;
• misrepresent your relationship with BEES Nest; or
• use the App in violation of applicable law or third-party rights.

We may restrict access if we reasonably believe the App is being misused or its security, operation, users, or legal compliance may be at risk.

You retain any rights that you or another legitimate rights holder have in the photos, videos, contacts, or other content processed through the App.

You represent that you have the authority required to access and manage the content you select. If a device, media library, or address book contains information belonging to another person, you are responsible for obtaining any permission required before reviewing, modifying, or deleting it.

Processing content through the App does not transfer ownership of that content to BEES Nest. We receive only the limited rights reasonably necessary to carry out a function you request.

You are responsible for:

• securing your device and access credentials;
• maintaining adequate backups;
• reviewing proposed cleaning results;
• confirming that selected actions are appropriate;
• managing permissions granted to the App; and
• complying with laws governing personal information and contact data.

The App may be offered through a combination of free functionality, advertising-supported access, subscriptions, free trials, lifetime purchases, or other in-app offers.

The exact features included in each offer will be displayed in the App or the applicable app marketplace. Access to a feature may depend on an active entitlement or restored purchase.

A free version may display advertisements. Declining tracking permission does not necessarily remove advertising; advertisements may instead be contextual or less personalized. Third-party advertisements and any products, websites, or services they promote are controlled by their respective providers.

Paid subscriptions are processed through the app marketplace account used to make the purchase.

Unless the offer expressly states otherwise:

• payment is charged after you confirm the purchase;
• the subscription automatically renews for the selected billing period;
• renewal is charged according to the marketplace’s billing schedule;
• your subscription continues until you cancel it through the relevant marketplace account; and
• deleting the App does not cancel the subscription.

You must cancel through your marketplace subscription settings before the applicable renewal deadline if you do not want another charge. Cancellation normally prevents future renewal but does not end access already paid for during the current billing period.

BEES Nest cannot directly cancel a marketplace-controlled subscription on your behalf.

Where a free trial is available, its duration, renewal period, and post-trial price will be shown before confirmation.

Unless cancelled within the period specified by the app marketplace, the trial may automatically convert into a paid subscription. Trial eligibility may be limited to qualifying users and is determined by the marketplace or the applicable offer.

Reinstalling the App, changing devices, or using another installation does not guarantee eligibility for an additional trial.

A lifetime purchase provides a one-time licence to use the premium features included in the specific offer for the supported operating life of LightSweep.

“Lifetime” refers to the supported life of the applicable App and does not mean:

• the lifetime of the purchaser;
• permanent support for every future device or operating system;
• ownership of the App or its source code;
• access to separate applications or unrelated services;
• access to features expressly sold separately; or
• a guarantee that every existing feature will remain technically available forever.

We will not use this provision to limit non-waivable consumer rights or avoid obligations applicable to an existing paid entitlement.

Prices may differ based on country, currency, taxes, billing period, promotion, or marketplace. The price and billing information displayed by the app marketplace immediately before purchase govern the transaction.

Purchases, billing, cancellations, and refunds are administered by the marketplace through which payment was made. Refund eligibility is determined under that marketplace’s rules and applicable consumer law.

Where the marketplace controls the transaction, BEES Nest may be unable to approve, reject, or issue a refund directly.

Certain functions require permission to access photos, videos, or contacts. If you refuse or revoke a permission, the related feature may be limited or unavailable.

Granting access does not authorize the App to delete or modify all available content automatically. You must still select or confirm the applicable operation where required by the feature or operating system.

System permissions and privacy controls are managed through your device settings. Revoking a permission does not cancel a paid subscription.

The App operates within an environment that may include an app marketplace, operating-system services, cloud synchronization providers, analytics services, advertising providers, and other third-party systems.

BEES Nest does not control and is not responsible for:

• marketplace billing, refund, or account decisions;
• changes to operating-system permissions or media-management behavior;
• cloud synchronization conflicts or delays;
• third-party storage or recovery periods;
• advertisements or external websites;
• third-party service interruptions; or
• another provider’s terms, privacy practices, or security.

Your use of those services may be governed by separate agreements between you and their providers.

Information associated with the App is handled as described in our Privacy Policy, which should be made available with the App or through its official marketplace listing.

The Privacy Policy explains the distinction between photos, videos, and contacts processed primarily on your device and technical, analytics, advertising, diagnostic, and purchase information that may be transmitted.

When contacting support, do not send private photos, videos, contact information, or other personal content unless it is strictly necessary to explain the issue.

The App and its software, interface, design, graphics, text, trademarks, branding, and original materials are owned by or licensed to BEES Nest and are protected by intellectual-property laws.

These Terms give you permission to use the App but do not transfer any intellectual-property rights to you.

If you provide comments or suggestions, we may use them to improve the App without an obligation to compensate you, provided that doing so does not transfer ownership of your personal content to us.

We may release updates to improve compatibility, reliability, security, or functionality. Certain updates may be necessary for continued use.

You acknowledge that operating-system changes, device limitations, marketplace requirements, or third-party service changes may affect the App. We do not guarantee continuing compatibility with devices or system versions that are no longer supported.

We may suspend or discontinue part of the App for legitimate technical, legal, security, or operational reasons. Where a material change affects paid rights, we will act in accordance with applicable law and marketplace requirements.

To the maximum extent permitted by law, the App is provided on an “as is” and “as available” basis.

We do not guarantee that:

• every duplicate or similar item will be identified;
• every result shown will be correct;
• use of the App will achieve a particular amount of free storage;
• deleted or modified content will always be recoverable;
• the App will operate without interruptions or errors; or
• every feature will work on every device or operating-system version.

Nothing in these Terms excludes warranties or consumer protections that cannot lawfully be excluded.

To the fullest extent permitted by applicable law, BEES Nest will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from your use of or inability to use the App.

This includes loss arising from:

• deletion of a photo, video, or contact selected by you;
• failure to maintain a suitable backup;
• inaccurate similarity, duplicate, size, or cleaning results;
• synchronization with a third-party account;
• loss, corruption, or alteration of locally stored content;
• device or operating-system failure;
• third-party advertisements or services; or
• loss of profits, opportunity, goodwill, or business information.

Where liability cannot be excluded, it will be limited only to the extent permitted by law. Nothing in these Terms limits liability for fraud, wilful misconduct, or any other liability that cannot legally be limited.

To the extent permitted by applicable law, you agree to be responsible for losses, claims, and reasonable expenses arising from:

• your unlawful use of the App;
• your unauthorized access to or management of another person’s content;
• your material violation of these Terms; or
• your infringement of another person’s rights.

This provision does not apply to losses caused by BEES Nest’s own unlawful conduct or where such an obligation is prohibited by law.

You may stop using the App at any time. If you no longer want the App, you may uninstall it, but uninstalling does not cancel a subscription or necessarily delete marketplace transaction records.

We may suspend or terminate the licence granted under these Terms if you materially breach them, misuse the App, interfere with its security, or use it unlawfully.

After termination, your permission to use the App ends. Provisions relating to payments already incurred, ownership, disclaimers, liability, and dispute resolution remain effective where their nature requires.

If you downloaded the App through Apple’s App Store, you acknowledge that these Terms are between you and BEES Nest, not Apple. BEES Nest, rather than Apple, is responsible for the App, subject to these Terms and applicable law.

Apple has no obligation to provide maintenance or support for the App. To the extent required by applicable marketplace rules, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the relevant provisions against you after your acceptance.

Nothing in this section changes rights or responsibilities that cannot be modified under applicable law.

We may revise these Terms when the App, its commercial model, legal requirements, or third-party dependencies change.

If a revision materially affects your rights, we will provide notice through the App, its marketplace listing, or another reasonable method where required. Continued use after updated Terms take effect constitutes acceptance to the extent permitted by law.

The effective date above identifies the current version.

These Terms are governed by the laws applicable to BEES Nest and the provision of the App, without depriving you of mandatory consumer protections available in your place of residence.

Before initiating formal proceedings, you may contact us and allow a reasonable opportunity to resolve the issue. An unresolved dispute may be submitted to a court with competent jurisdiction, subject to any forum rights provided by applicable consumer law.

If any provision is found invalid or unenforceable, the remaining provisions will continue in effect. A failure to enforce any provision does not waive our right to enforce it later.

You may not transfer your licence or obligations under these Terms without our consent. We may transfer our rights and obligations in connection with a lawful merger, restructuring, financing, or transfer of the App or relevant business assets.

These Terms, the Privacy Policy, and the purchase information presented by the applicable app marketplace form the agreement governing your use of the App.
